Most borrowers only notice the last one, and very few know what it is allowed to be.

Penal charges changed meaningfully on 1 April 2024, when the Reserve Bank of India’s Fair Lending Practice rules came into force. Lenders can no longer quietly raise your interest rate as a punishment. What they can charge, how it must be disclosed, and how you can keep it off your account is what this guide covers.

What penal charges mean

Penal charges are a fixed fee or a percentage-based charge a lender levies when a borrower breaks a material term of the loan agreement. The most common trigger is a late or missed EMI.

They are separate from the interest you owe. Your regular interest keeps running on the outstanding principal; penal charges sit on top as a penalty for the breach.

In plain terms, “penal charges meaning” in a loan statement is: the price of not doing what you agreed to do, on time.

Penal charges vs penal interest: what RBI changed

Before 2024, many lenders charged “penal interest”: an extra 2% to 3% per month, added to the loan’s interest rate for the overdue period. That extra interest was often capitalised, meaning it was added to your principal and then earned interest itself.

The RBI’s circular on Fair Lending Practice Penal Charges in Loan Accounts (18 August 2023), effective for new loans from 1 April 2024, changed this. The key rules:

No penal interest. A penalty for breaching loan terms must be levied as “penal charges”, not as an addition to the interest rate.

No capitalisation. No further interest can be computed on penal charges. They cannot compound.

Reasonable and proportionate. The quantum must be commensurate with the breach, and not discriminatory within a loan category.

Individuals get parity. Penal charges on personal (non-business) loans to individuals cannot be higher than those on non-individual borrowers for the same breach.

Full disclosure. The amount and reason must appear in the loan agreement, the Key Fact Statement, and the lender’s website under interest rates and service charges.

Communication. Each time a penal charge is levied, the lender must tell you and state the reason.

RBI did not set a numerical cap. It did say that penal charges are meant to build credit discipline and must not be used as a revenue-enhancement tool.

Existing loans had to move to the new regime at their next review or renewal, and no later than 30 June 2024. If you took your personal loan in 2024 or later, the new rules apply to it.

When lenders levy penal charges

Missed payments are the most common reason, but not the only one. Loan agreements typically list penal charges for:

EMI not paid by the due date, or paid partly

NACH or auto-debit mandate returned unpaid (this may be a separate “bounce charge”)

Cheque dishonour

Failure to submit required documents after disbursement, such as end-use proof for certain loans

Breach of covenants on secured loans, such as failing to renew insurance on a pledged asset

For an unsecured personal loan, the first two account for almost all penal charges borrowers see.

What a missed EMI actually costs

A single missed EMI usually generates more than one charge. Take a borrower with a ₹5 lakh personal loan, EMI ₹11,634, who misses one payment by 20 days.

Cost item

Who charges it

Typical range (illustrative)

NACH or ECS return fee

Your own bank

₹250–₹750 + GST

EMI bounce charge

Lender

₹400–₹750 + GST

Penalty charge for delay

Lender

Flat fee, or about 2%–3% per month on the overdue EMI only

Regular interest

Lender

Continues on principal as scheduled

Credit report impact

Credit bureau

DPD (days past due) of 1–29 reported

On a ₹11,634 EMI, a 24%-a-year penal charge for 20 days works out to roughly ₹150. The bounce fees are usually larger than the penal charge itself. Together, a single late EMI commonly costs ₹1,000 to ₹2,000 in fees.

The credit report impact costs more than the fees. Even a 1–29 day delay shows up in your repayment history, and it is the first thing the next lender looks at.

Where to find your lender’s penalty charges

You do not need to wait for a statement to know what you will be charged. Check three places:

Key Fact Statement (KFS). Every retail and MSME loan must come with a KFS that lists penal charges in a standard format. It is the easiest document to read.

Loan agreement or sanction letter. Look for sections titled “Schedule of Charges” or “Penal Charges”.

Lender’s website. RBI requires penal charges to be published under interest rates and service charges.

If you took the loan through a digital platform, the KFS link should also be visible in the app. Our guide to the Key Fact Statement explains how to read it line by line.

How to avoid or reduce penalty charges

Align the EMI date with your salary date

Many bounces happen because the EMI is set for the 1st or 2nd of the month and salary lands on the 5th or the 7th. Most lenders will change the EMI date once, on request, sometimes with a small broken-period interest adjustment.

Keep a one-EMI buffer in the debit account

A balance equal to one EMI in the mandate account removes most timing risk. If you run several loans, a buffer equal to the largest EMI is enough.

Pay before the due date if you know you will be short

If you can see a shortfall coming, call the lender before the due date. A payment made through the app or a payment link before the mandate is presented avoids both bounce fees.

Ask for a reversal the first time

Lenders often reverse a first-time penalty charge for a borrower with a clean record. Ask in writing, mention your repayment history, and keep the reference number.

Challenge charges that break the rules

If a penal charge was added to the interest rate, compounded, not disclosed in your KFS, or not communicated to you, raise it with the lender’s grievance officer. If there is no satisfactory response within 30 days, you can file on the RBI’s Complaint Management System at cms.rbi.org.in.

When penal charges signal a bigger problem

One late EMI is a timing issue. Penal charges showing up two or three months in a row usually mean the EMIs themselves are too heavy for your income.

A simple test: if your total EMIs are more than 50% of your take-home pay, penalties are a symptom, not the cause. At that level, each month carries the risk of a bounce, and every bounce makes the next loan harder to get.

The practical options at that point are to lower the combined EMI rather than keep paying fees:

Balance transfer of the costliest loan to a lender offering a lower rate. See our personal loan balance transfer guide.

Debt consolidation, combining several loans and card balances into one longer-tenure loan with a single EMI. See how debt consolidation works in India.

Restructuring with your existing lender if your income has dropped. See loan restructuring after missed EMIs.

These work best before your account reaches 60 or 90 days past due. After that, most lenders will not refinance you. Our guide on what happens after three missed EMIs walks through the stages.

Use cases

Salaried borrower with a date mismatch. Riya’s salary arrives on the 7th and her EMI on the 3rd. She bounced twice in six months. Changing the EMI date to the 10th removed the problem at no ongoing cost.

Borrower with three loans and a card. Arjun pays four EMIs totalling 62% of his salary and sees penal charges most months. Consolidating two app loans and his card balance into one personal loan cut his outflow to 44% of salary, and the bounces stopped.

Key takeaways

Penal charges are a fee for breaking loan terms, most often a late EMI.

Since April 2024, lenders cannot charge penal interest or compound penal charges.

Charges must be disclosed in your KFS and communicated each time they are levied.

The fees from one missed EMI are modest; the credit report impact is not.

Repeated penal charges are a sign to reduce your EMI burden, not just to pay the penalty.

Frequently Asked Questions

What is the meaning of penal charges in a loan?

Penal charges are fees a lender charges when you break a material term of the loan, such as paying an EMI late. RBI requires penal charges to be reasonable, proportionate to the breach, disclosed upfront, and not used to boost lender revenue. Penal charges on personal loans to individuals cannot exceed those on non-individual borrowers for the same breach.

Can a lender charge interest on penal charges?

No. Since the 2024 rules, penal charges cannot be capitalised, so no interest can be calculated on them.

Do penal charges affect my CIBIL score?

The charge itself is not reported, but the late payment that caused it is. Ask the lender in writing. If a charge breaks RBI rules, escalate to the grievance officer and then to the RBI Ombudsman.

Conclusion

The 2024 rules made penalty charges more transparent and less punishing. They did not make late payments free. The fees are small; the credit damage and the cycle of recurring bounces are what cost borrowers most.

If penalties have become a monthly line item, the fix is almost always a smaller total EMI. TapTap Loans compares 20+ banks and NBFCs to find a consolidation or balance transfer that brings your EMIs back within your income, with a soft credit check that does not affect your score.

Check how much you could reduce your EMIs.

Home » Penalty Charged

Miss one EMI and your next bank statement may show three separate debits you did not plan for: a bounce fee from your own bank, a bounce fee from the lender, and a line called “penal charges”.
