RBI’s New Device Rules Explained

Editor’s note: The notice periods and compensation amounts below combine the final directions of 6 August 2026 with the May 2026 draft. Confirm each figure against the RBI text before publishing.

More than a third of consumer electronics in India are bought on credit, according to a 2024 Home Credit study, and smartphones make up a large share of those loans. For years, some lenders used software installed at the point of sale to lock or slow a phone when an EMI was missed. RBI pushed back in 2024, then spent two years deciding what, if anything, to allow.

On 6 August 2026, it settled the question. A set of amendment directions on responsible business conduct, effective 1 January 2027, bans device locking as a general recovery tool and permits only narrow, phased restrictions on a device the lender itself financed. Here is what the rules say, what they mean for borrowers, and how to protect yourself.

What RBI issued and when it applies

RBI released draft amendments on loan recovery conduct on 20 May 2026 and finalised them on 6 August 2026. Separate directions went to each type of regulated lender: commercial banks, small finance banks, regional rural banks, local area banks and co-operative banks received Fourth Amendment Directions, while NBFCs, housing finance companies and all-India financial institutions received Third Amendment Directions.

The device rules sit inside a wider overhaul of recovery practices, including stricter conduct requirements and certification for recovery agents. All of it takes effect on 1 January 2027, which gives lenders time to change contracts, consent forms and the software on financed devices.

Until then, earlier RBI guidance discouraging device locking continues to apply, and any restriction you face today should already be backed by your loan agreement and consent.

The general rule: no locking devices to recover other loans

The central principle is simple. A lender cannot use technology to disable or restrict your phone, tablet, or laptop to recover dues on a loan that was not used to buy that device.

If you default on a personal loan, a credit card, a car loan or a home loan, the lender cannot reach into your phone. Recovery has to follow the regular route: reminders, notices, lawful recovery-agent contact and, where needed, legal proceedings.

This closes a gap that worried consumer groups. A phone is now the primary channel for banking, UPI, government services and work, so disabling it can cut a borrower off from the very tools needed to repay.

The exception: devices the lender financed

Where the lender actually financed the purchase of the device, limited restrictions are permitted, but only within a tightly defined sequence.

Phased, not instant

Restrictions cannot begin the day after a missed EMI. Reporting on the final rules describes graduated limits on non-essential functions only after the loan is overdue, with the full set of restrictions written into the agreement allowed only once the loan is 60 days past due. Outgoing calls cannot be restricted before 60 days.

The May 2026 draft spelled out the notice sequence: a notice once the loan reaches 60 days past due giving at least 21 days to pay, followed by a further 7-day notice before restrictions start.

Disclosed upfront

The conditions for any restriction must be written into the loan agreement, with the borrower’s explicit consent. A restriction that is not in your agreement is not permitted.

Never a full lock

The lender cannot brick the device. Essential functions, including emergency calls and basic communication, must remain available. The intent is to create an incentive to pay, not to cut off access to help.

Safeguards every borrower should know

Safeguard

What it means for you

Only the financed device

A default on any other loan cannot lead to your phone being restricted

Agreement and consent

Restrictions must be disclosed in the loan contract before you sign

Prior notice

You must be warned and given time to pay before any restriction

Essential functions protected

Emergency and core communication stay available throughout

No access to personal data

The lender cannot read or use the data stored on your phone

Prompt restoration

Restrictions must be lifted quickly once dues are cleared; the draft set a one-hour limit.

Compensation

Wrongful restriction or delayed restoration attracts compensation, which the draft set at ₹250 an hour, capped at the loan amount disbursed

Right to prepay

You can repay the device loan in full or in part at any time

The compensation cap matters. On a ₹20,000 phone loan, the maximum a lender could owe for a wrongful lock is ₹20,000, which is large relative to the loan and gives lenders a strong reason to get the process right.

What this means in practice

For borrowers buying a phone on EMI

Read the device-restriction clause before you sign. If the store staff cannot show it to you, ask for the full loan agreement and Key Fact Statement.

Note the lender’s name, not just the retailer’s. Many point-of-sale loans come from NBFCs, and complaints go to the lender.

Keep your NACH mandate funded. Most device loans default because an auto-debit bounced, not because the borrower chose not to pay.

For borrowers already struggling with EMIs

A phone loan is often a small part of a bigger problem. If several small-ticket loans, app loans, and card dues are running at once, a device restriction is a symptom.

Rolling those debts into one lower-cost loan removes the pressure point. TapTap’s guide to what happens after 3 missed EMIs explains the reporting and recovery timeline you should stay ahead of.

If a restriction looks wrongful

Pay or confirm the dues, and record the payment time.

Raise a written complaint with the lender’s grievance officer, citing the loan account number and the time of restoration.

If the lender does not resolve it within 30 days, escalate to the RBI Ombudsman. Our guide to filing an RBI Ombudsman complaint walks through the process.

Also keep the rules on recovery conduct in mind. Threats, calls at odd hours,s or contact with your family or employer are prohibited, as covered in our RBI rules on loan recovery agents.

Use cases

Karan financed a ₹28,000 smartphone through an NBFC at the store and also has a personal loan from a bank. He misses two personal loan EMIs. Under the new rules, the NBFC that financed his phone has no grounds to restrict it, and the bank cannot touch the device at all.

Sneha misses her phone-loan EMI for 70 days after a job change. She receives notices and, after the notice period, some non-essential functions are limited as her agreement allows. She pays the overdue amount; the lender must restore the device promptly, and if it delays, she can claim compensation.

Key takeaways

RBI’s directions of 6 August 2026 take effect on 1 January 2027 for banks, NBFCs and other regulated lenders.

Lenders cannot restrict any device to recover dues on a loan that did not finance that device.

For financed devices, restrictions are phased, disclosed in the agreement, preceded by notice, and never a full lock.

Personal data on the device is off-limits, and wrongful or delayed restoration attracts compensation capped at the loan amount.

If restrictions are threatened over a different loan, that is a complaint, not a lawful recovery step.

Frequently asked questions

Can a bank lock my phone if I miss a personal loan EMI?

No. Under the 2026 directions, a lender cannot restrict a device to recover dues on any loan that was not used to buy that device.

When can a lender restrict a phone bought on EMI?

Only if the restriction is in your loan agreement; only after the loan is overdue and notices have been given; and the full set of agreed restrictions only after 60 days past due.

Can the lender see my photos, contacts, or messages?

No. The directions prohibit lenders from accessing personal data stored on the device.

How quickly must the phone be unlocked after I pay?

Promptly. A phone is no longer a lever lenders can pull for unrelated debts, and even for financed devices, the process is slow, disclosed, and reversible. For borrowers, the practical lesson is older than the rule: read the agreement before you sign, and deal with EMI stress before it reaches day 60.

If multiple EMIs are crowding your month, see how TapTap Loans can help you consolidate them.

Home » RBI Device Locking Rules for Loans

Editor’s note: The notice periods and compensation amounts below combine the final directions of 6 August 2026 with the May 2026 draft.
